Primary Care Doctor’s Affair With Patient Could Be Malpractice

A Washington state woman and her family can go to trial on medical malpractice claims against the estate of a primary care doctor with whom she had an affair, a state appeals court said.

Monique Messenger raised genuine issues of material fact as to whether Bryan Whitemarsh breached the standard of care by having a sexual relationship with her while she was his patient, the Washington Court of Appeals, First Division, said Monday.

The court overturned summary judgment for Whitemarsh’s estate.
