Ohio Spinal Surgery Patients Get New Chance at Negligence Suit

Patients whose spinal surgeon allegedly duped them into having medically unnecessary procedures will get a second chance to sue him for medical malpractice, an Ohio appeals court said.

Ohio’s savings statute allows people who have voluntarily dismissed medical malpractice claims to revive them in later lawsuits, even if the second suit would be barred by statutory time limits for filing new suits, the Ohio Court of Appeals, First District, said.
