California-based litigation over the validity of Trump administration rules exempting certain employers from Obamacare’s requirement to provide health insurance that pays for birth control is heading back to a federal trial court, the Ninth Circuit said.
The U.S. Court of Appeals for the Ninth Circuit vacated a preliminary injunction that prevented the departments of Health and Human Services, Labor, and Treasury from allowing employers in 13 states and the District of Columbia to take advantage of the opt-outs if they object to providing the coverage on religious or moral grounds.
