NY Hospital to Pay $12.3 Million Over Simultaneous Surgeries

Lenox Hill Hospital in New York will pay $12.3 million to settle allegations it fraudulently billed Medicare for simultaneous surgeries performed by the former chair of the hospital’s Department of Urology, the Department of Justice said.

The department chair, David B. Samadi, routinely scheduled two separate surgeries, one endoscopic and one robotic, at the same time in adjacent operating rooms, the DOJ said in a Nov. 8 statement.

But the result was that the endoscopic surgeries were performed at least in part by medical residents who were not supervised as required under Medicare’s rules, the statement said.
