North Carolina Pharmacy Must Face Whistleblower’s FCA Suit

A North Carolina pharmacy and its owner must face claims they violated the False Claims Act by improperly billing federal healthcare programs for prescription drugs, a North Carolina federal court said Wednesday.

Whistleblower Bronson Lowery adequately alleged that All Medicines Inc.—doing business as Townsend’s Pharmacy—and owner James Craig Bell billed Medicare and Medicaid for prescription drugs that weren’t dispensed, and for name brand drugs instead of the generic drugs actually dispensed, Judge Louise W. Flanagan of the U.S. District Court for the Eastern District of North Carolina said.
