New Obamacare Insurance Rules May Moot States’ Suits

New federal rules exempting religious employers from Obamacare’s birth control mandate may lead to the end of state litigation over previous opt outs.

California and Pennsylvania should drop lawsuits seeking to enjoin substantially similar interim final rules, Mark Rienzi, an attorney for the Little Sisters of the Poor, said in a Nov. 8 press call. Rienzi is with the Becket Fund for Religious Liberty, a public interest law firm in Washington. The Little Sisters are an order of nuns that provides nursing services for the elderly poor.
