Two men who want to open a home health-care agency to serve the Nepalese-speaking community in Kentucky are asking a federal appeals court to decide on the legality of the state’s certificate of need program.

Dipendra Tiwari, Kishor Sapkota, and their home health care agency, Grace Home Care Inc., filed a notice of appeal from a decision by the U.S. District Court for the Western District of Kentucky dismissing their allegations that the certificate of need requirements violate the 14th Amendment’s due process and equal protection clauses.
