Mississippi Nursing Home Again Beats False Claims Suit on Appeal

A Mississippi nursing home convinced the Fifth Circuit Tuesday not to revive a False Claims Act suit alleging that it improperly billed Medicaid and Medicare because its nursing director lacked a valid nursing license.

Purported whistleblower and attorney Cameron Jehl sought more than $30 million in damages in a suit accusing GGNSC Southaven LLC, also known as Golden Living Center, of knowingly employing a nursing director who was not licensed or lawfully authorized to practice in the state.
