Medicare Off-Campus Clinic Pay Rule Properly Ditched: Hospitals

Hospitals that operate off-campus clinics are urging a federal appeals court in Washington, D.C., to affirm a decision that invalidated a rule lowering their Medicare pay to equal the rate for services provided at physician’s offices.

The Health and Human Services Department’s Centers for Medicare and Medicaid Services lacked Congressional authority to adopt a final rule that cut the hospitals’ Medicare payments by about $760 million per year, the American Hospital Association, the University of Kansas Hospital Authority, and others told the U.S. Court of Appeals for the District of Columbia Circuit on Thursday.
