Medicare Likely Overpaid $42.3 Million for Advance Care Planning

Medicare providers that billed for in-office advance care planning services in 2019 were likely paid about $42.3 million for activities that didn’t comply with federal requirements, a government watchdog agency said Wednesday.

The report by the HHS Office of Inspector General recommends that the Centers for Medicare & Medicaid Services recoup the actual amount of improper payments in its sample—$33,332—and better educate providers on proper documentation and time requirements when providing planning services.

“Had the requirements been followed, Medicare could have saved an estimated $42.3 million during our audit period,” the OIG report said.
