Medicare Drug-Rate Ruling Cleared for Trump Appeal by Judge (1)

A federal court cleared the way for the Trump administration to appeal two earlier court rulings that found the Department of Health and Human Services had overstepped its authority in reducing drug payments to hospitals serving low-income communities.

The U.S. District Court for the District of Columbia July 10 granted the government’s request for final judgment in the case. Hospitals sued challenging the agency’s decision to cut Medicare payments for certain drugs covered by the government’s “340B” program by nearly 30 percent in its 2018 and 2019 rules.
