Massachusetts Can Sue to Stop Obamacare Coverage Exemptions

Massachusetts can challenge Trump administration rules exempting employers with religious or moral objections from Obamacare’s birth control insurance coverage requirements, a federal appeals court ruled May 2.

The state adequately demonstrated it will suffer economic harm if employers are allowed to opt out of providing employees with health insurance that covers birth control and related services at no cost to the employees, the U.S. Court of Appeals for the First Circuit said. It overturned a ruling that dismissed the state’s lawsuit for lack of standing.
