A Louisiana dentist’s lawsuit against the state’s licensing board was patently frivolous because the state’s general one-year time period for filing personal injury claims clearly barred it, a federal appeals court said.
Ryan Haygood must pay the Louisiana State Board of Dentistry nearly $100,000 for attorneys’ fees for filing the federal suit more than one year after he knew or should have known he had a cause of action, the US Court of Appeals for the Fifth Circuit said Tuesday. The relevant time period began running when Haygood filed a state-court lawsuit complaining about the board’s actions, it said.
