Losing Insurers Shouldn’t Get Obamacare Money, U.S. Tells SCOTUS

Health-care insurers stripped of the right to collect more than $12 billion for the government’s failure to support Obamacare’s risk corridor program are out of luck, the U.S. told the U.S. Supreme Court.

Congress never appropriated the money to pay insurers that lost money by offering Affordable Care Act-compliant plans at low rates, and made clear it intended the program to pay for itself, the government said in May 8 brief. It urged the Supreme Court to deny review of a decision by the U.S. Court of Appeals for the Federal Circuit that upheld its position.
