Kentucky Hospital Group Wants In on Certificate of Need Law Row

Kentucky health-care providers have an interest in protecting the state’s certificate of need law that won’t be represented adequately by state government officials charged with defending the law against a constitutional challenge, the Kentucky Hospital Association said.

The group is seeking permission from the U.S. District Court for the Western District of Kentucky to enter a lawsuit in which a home health agency owner alleged the law violates the 14th Amendment’s Due Process Clause by denying him the right to make a living.
