Employees at Kentucky’s Saint Elizabeth Medical Center Inc. must comply with the hospital’s Covid-19 vaccine mandate while its legality is being debated, a federal district court in the state said.
The employees aren’t likely to win on their argument that the mandate violates their constitutional rights, because Saint Elizabeth’s is a private hospital and there is no state action involved, the U.S. District Court for the Eastern District of Kentucky said.
The court denied the employees’ motion for a temporary restraining order or preliminary injunction blocking the hospital from enforcing the vaccine mandate.
