Kentucky ‘Discrimination’ Abortion Ban Blocked, For Now

Kentucky can’t prohibit abortions based on a fetus’s sex, race, color, national origin, or diagnosis of Down syndrome or other disability, at least temporarily.

The right to abortion is categorical, the U.S. District Court for the Western District of Kentucky said March 20 in an order blocking the state from enforcing a new law prohibiting abortions for allegedly discriminatory reasons.

The only limit on that right identified by the U.S. Supreme Court is viability, or the fetus’s ability to live outside the womb, it said.
