J&J Talc Users Appeal Dismissal of Consumer Deception Suit

Consumers have appealed dismissal of a proposed class suit alleging Johnson & Johnson Consumer Inc. and Bausch Health US LLC violated consumer protection laws by misrepresenting Baby Powder and Shower to Shower talcum powders as safe and pure, a federal appeals court filing shows.

Louisa Gutierrez and Debbie Luna alleged the marketing was deceptive because the powders contained asbestos and other hazardous substances.

In January, Judge Todd W. Robinson of the U.S. District Court for the Southern District of California threw out their sixth attempt at filing viable claims. The plaintiffs didn’t show the products contained unsafe levels of contaminants ...
