Insurer That Refused to Pay for Cancer Patient’s MRI Beats Suit

Group Health Inc. avoided a lawsuit alleging it negligently denied coverage for a diagnostic test that would have revealed a member’s cancer in time to prevent her leg’s amputation, with a ruling by a federal court in New York.

The existence of an insurance contract between GHI and Kathleen Valentini precluded the suit, as the tort claims alleged by her family and estate essentially sought its enforcement, the U.S. District Court for the Southern District of New York said.
