Indiana, Abortion Providers Split Pretrial Ruling in Challenge

Indiana can enforce abortion restrictions like provider licensing and reporting requirements, but must go to trial to defend a physician-only law, a telemedicine ban, and other provisions because they may impose an undue burden on abortion, a federal court in the state said.

Whole Woman’s Health Alliance led a challenge to a broad array of Indiana abortion restrictions. It partially fended off the state’s motion for summary judgment on several provisions that allegedly violate the 14th Amendment’s due process clause, the U.S. District Court for the Southern District of Indiana said Oct. 9.
