Indiana Abortion Providers’ Facility Regulation Claim Proceeds

Indiana abortion providers can proceed to trial on a claim that state regulations governing facilities that provide medication abortions are unconstitutional because their complaint clearly challenged those rules, a federal trial court said Tuesday.

Indiana and providers Whole Woman’s Health Alliance, All-Options Inc., and physician Jeffrey Glazer split a court ruling on motions for summary judgment in October 2020. The case thus will go to trial on several issues.

But the U.S. District Court for the Southern District of Indiana expressed confusion at the time over the providers’ challenge to regulations governing abortion facilities.
