Illinois Public Hospital Escapes Negligent Misdiagnosis Suit

A public hospital in Illinois will escape liability for misdiagnosing a patient’s cardiopulmonary disease as anxiety because state law provides it with governmental immunity, the Seventh Circuit said.

Sparta Community Hospital District is a local public entity subject to the Illinois Tort Act, the US Court of Appeals for the Seventh Circuit said. The act gives public health-care entities immunity from liability for failing to adequately diagnose a medical condition, it said.
