Illinois Hospital Beats Civil Rights Claims Over Newborn Care

Illinois parents lost their civil rights lawsuit against medical providers who reported them to a child services agency for refusing permission to treat their newborn with an eye ointment designed to protect against sexually transmitted diseases, a federal court said.

Silver Cross Hospital and Medical Center wasn’t a state actor for purposes of Gina and Roma Churnovic’s lawsuit alleging it violated their substantive due process right to familial integrity, the U.S. District Court for the Northern District of Illinois said.
