Idaho’s Birth Certificate Policy for Trans People Still Blocked

Idaho can’t automatically reject applications to change the sex listed on a person’s birth certificate to match their gender identity, a federal court in the state said.

The U.S. District Court for the District of Idaho clarified Monday that a permanent injunction it entered in 2018 that requires state officials to accept, consider, and process applications remains in effect, despite Idaho’s recent enactment of a law that requires the sex listed on a person’s birth certificate to match their reproductive anatomy at birth.
