Home Health Service Upcoding Suit Rejected by Sixth Circuit

A home health agency nurse and whistleblower failed to adequately allege that a diagnosis coding firm and several home health-care companies violated the False Claims Act by overbilling Medicare, the U.S. Court of Appeals for the Sixth Circuit affirmed.

Cathy Owsley claimed Fazzi Associates Inc. fraudulently upcoded patient data that Care Connection of Cincinnati used to submit inflated payment requests to Medicare. Other defendants named in her suit were Care Connection’s holding company Envision Healthcare Holdings Inc., and other companies controlled by Envision, Gem City Home Care and Ascension Health Care.
