HHS Tells Court It Will Reconsider Transgender Bias Rule

The HHS has asked a federal court to allow it to re-evaluate a rule prohibiting health-care discrimination against transgender individuals (Franciscan Alliance, Inc. v. Price, N.D. Tex., 7:16-cv-108, motion for remand 5/2/17).

The Health and Human Services Department asked Judge Reed C. O’Connor of the U.S. District Court for the Northern District of Texas to remand the case back to the agency and place a hold on further action. The agency’s May motion said HHS leadership “should be given an opportunity to reevaluate the regulation and address the issues raised in this litigation through proper rulemaking proceedings.” The ...
