Healthsouth Prevails in Doctor’s Whistleblower Retaliation Suit

The former medical director of a Healthsouth Corp. inpatient rehabilitation facility lost a False Claims Act whistleblower retaliation case because he didn’t show the company knew he was engaged in protected activity and took adverse action in response, a federal court in Florida said.

None of the matters Darius Clarke brought to Healthsouth’s attention before he resigned would have put the company on notice that he was complaining about or trying to prevent potential FCA violations, the U.S. District Court for the Middle District of Florida said Friday.
