Foreign Object Medical Malpractice Claim Revived in Ohio

An Ohio man will get a second chance to sue medical providers over a surgical clamp left in his body because a state trial court didn’t analyze if he knew or should have known the clamp was a “foreign object” more than a year before filing his claims, an Ohio appeals court said.

John Pedersen and Michael Parker performed leg surgery on Adam Peters at Akron General Medical Center in 2013. Orthopedic surgeon Erika Glass found “something metallic” that she thought could be a clamp on an x-ray taken prior to a total knee replacement surgery the following June.
