Florida Hospital Denied New Negligence Trial Over Jury Strikes

A Florida hospital failed to convince a state appeals court that it should get a new trial, after its bid to strike a Black licensed practical nurse from a medical malpractice jury was denied because the hospital had already used too many strikes against other potential Black jurors.

Hialeah Hospital Inc. demonstrated an “impermissible pattern of seeking to excuse potential jurors based on race” when it attempted to strike three Black potential jurors in a row, the Florida District Court of Appeals, Third District, said Wednesday.
