Fifth Circuit Refuses to Block Texas Private Abortion Suit Law

A Texas law that bans abortions after about six weeks and allows private parties to sue abortion providers for alleged violations is on its way to taking effect Sept. 1, as the Fifth Circuit refused to block it during an appeal.

A series of emergency motions culminated Sunday with an order by the U.S. Court of Appeals for the Fifth Circuit denying abortion providers’ bid for a preliminary injunction to stop enforcement of the law known as S.B. 8 while it considers an appeal from an order denying state officials’ attempt to dismiss the providers’ suit.
