Family Planning Program ‘Gag’ Rule Enforceable, HHS Says

The federal government should be allowed to enforce new rules prohibiting health-care providers that receive federal family planning program money from discussing abortion with their clients, the Health and Human Services Department said.

The rules mirror Reagan-era regulations upheld by the U.S. Supreme Court in 1991, the HHS told the U.S. District Court for the Northern District of California April 8. California, in seeking a decision blocking the rules’ enforcement, essentially is asking a federal trial court to overrule the Supreme Court, it said.
