Family Planning ‘Gag’ Rule Case Proceeds Despite Pending Appeal

A federal district court will proceed with litigation over a new Trump administration rule that prohibits providers that receive taxpayer money from referring women for abortions.

The interests of justice and judicial economy will be better met by allowing the court to consider if the rule governing recipients of Title X family planning program grant money is valid than by halting the case while an appeal from an order blocking the administration from enforcing the rule is pending, the U.S. District Court for the Eastern District of Washington said June 14.
