Facebook Post by UPMC Nurse Didn’t Invade Patient’s Privacy

A patient who wasn’t named or otherwise identified in a UPMC Susquehanna nurse’s Facebook post can’t sue the health-care provider for invasion of privacy, a Pennsylvania appeals court said.

Cynthia Shaner didn’t allege the post would have been highly offensive to a reasonable person, or that it was substantial enough for a reasonable person to strongly object to it, the Pennsylvania Superior Court said Tuesday.

Shaner went to UPMC Susquehanna’s emergency room complaining of chest pains. A registered nurse at the facility who had no contact with Shaner allegedly electronically accessed her medical records, she said.
