Eating Disorder Coverage Suit Against Humana Revived on Appeal

A patient who sued Humana Health Plan Inc. for refusing to fully cover the three months she spent in a treatment center for her eating disorder scored a victory on Thursday, when the U.S. Court of Appeals for the Fifth Circuit revived her lawsuit.

There’s a factual dispute over whether less intensive levels of care were unsuccessful in treating the patient’s eating disorder, the court said. The district court was wrong to award Humana summary judgment in the face of this conflicting factual evidence, the court concluded.
