D.C. Circuit Declines to Hear Out-of-Circuit Covid Injury Cases

Two Pennsylvania nursing homes failed to convince the D.C. Circuit to hear interlocutory appeals from an out-of-circuit district court that refused to dismiss suits arising out of residents’ Covid-19 related deaths.

The Public Readiness and Emergency Preparedness Act doesn’t give the US Court of Appeals for the D.C. Circuit jurisdiction to hear appeals from courts outside its geographical boundaries that deny defendants immunity, the court said.

Pennsylvania nursing home residents Anne Jean Cannon and Christopher Beatty died of Covid-19. Their families sued Blue Bell Place and Fair Acres Geriatric Facility for negligence.
