Court Gives Ambulance Group Lifeline in Medicare Dispute

A Texas ambulance company was saved from assured bankruptcy when a federal trial court enjoined the HHS from withholding future Medicare payments.

Judge Lee Rosenthal of the U.S. District Court for the Southern District of Texas July 11 enjoined the Department of Health and Human Services from withholding over $400,000 in Medicare payments from the Adams EMS Inc. while the provider waits for an HHS administrative law judge to review its case. Statutorily, a Medicare reimbursement appeal is supposed to be provided within 90 days, but the current wait time is between three and five years.
