Costa Cruise Lines Inc. avoided a proposed class action by a passenger who alleges the cruise operator’s negligence contributed to a Covid-19 outbreak aboard the Costa Luminosa, as the Eleventh Circuit affirmed he must litigate in an Italian court, under Italian law.
Paul Turner alleged that on Feb. 29, 2020, the ship had to dock in the Cayman Islands and evacuate an Italian passenger who presented with symptoms consistent with Covid-19. The passenger tested positive for Covid-19 and died.
