Connecticut Patient Not Liable for Injuring Nurse During Care

A Connecticut nurse can’t recover damages in a negligence action against a patient who allegedly injured her during an examination because the patient didn’t owe her a duty of care, a state appeals court said.

Imposing a duty of care on a patient under these circumstances would be inconsistent with the state’s public policy, the Connecticut Appellate Court said in an opinion released Jan. 10. The court affirmed summary judgment for the patient, William Bulkley, in a case of first impression in the state.
