Class Status Partially Granted in Excellus Data Breach Lawsuit

A lawsuit against Excellus Health Plan and several associated health care companies over a 2013 hacking incident that compromised personal data for approximately 10 million individuals has been granted class status, but only for plaintiffs’ claims for injunctive relief under New York law.

The class, certified Monday by the U.S. District Court for the Western District of New York, comprises all individuals in the United States whose personal information was stored on Excellus’s systems between Dec. 23, 2013, and May 11, 2015, who “are included in Excellus’s list of Impacted Individuals,” and whose personal information “currently resides in Excellus’s systems.”...
