California Prosecutors Can Bring Statewide Claims Over Generics (1)

Abbott Labs and other cholesterol drug manufacturers will have to defend lawsuits by a California district attorney alleging they engaged in a scheme to keep generic versions of Niaspan off the market, the state supreme court ruled Thursday.

Justices unanimously held local prosecutors don’t need the attorney general’s OK to bring an unfair competition lawsuit on behalf of the whole state seeking restitution for violating California’s unfair competition law. An intermediate appellate court had ruled the district attorneys couldn’t reach outside their jurisdiction.
