Bayer Keeps Essure Contraceptive Cases in Federal Court

Bayer Corp. and related companies can keep two dozen Essure contraceptive cases in federal court in Pennsylvania.

A procedural rule that would keep the suits in Pennsylvania state court because one of the Bayer defendants is a citizen of Pennsylvania doesn’t apply, the U.S. District Court for the Eastern District of Pennsylvania said.

Companies generally prefer to litigate in federal court, which are generally more business-friendly. Plaintiffs say state courts will better protect their rights.
