Arkansas Asks Eighth Circuit to Reinstate Abortion Restrictions

Arkansas should be allowed to enforce three “commonsense” laws regulating abortion, including an 18-week gestational age ban, a genetic discrimination bar, and a board-certified physician-only requirement, the state told the Eighth Circuit in its opening brief on appeal from an lower court order blocking the laws.

The state argued that a federal court in Arkansas in August wrongfully declared “a novel, absolute right to previability abortion” that is unsupported by U.S. Supreme Court precedent. It asked the appeals court to vacate or reverse the preliminary injunction.
