Apple Faces Dubious Federal Circuit on Patent Ownership Argument

Two Federal Circuit judges pressed Apple Inc. on contract language at the center of a dispute over whether the company that sued Apple for infringement owns the patents at issue.

Omni MedSci Inc. alleged the Apple Watch infringed its U.S. Patent Nos. 9,651,533 and 10,188,299 on health-related sensors. But Apple argued that Omni doesn’t own the patents because the inventor who sold them to Omni had automatically assigned them and other future inventions to his former university employer.
