Illinois anti-abortion groups will ask the state supreme court to take up their challenge to a law that requires the state to pay for elective abortions.
Springfield Right to Life, other anti-abortion groups, and state lawmakers sued state officials to invalidate a law that rolled back provisions prohibiting the use of taxpayer money to pay for abortions. The political question doctrine barred the suit, the Illinois Appellate Court said Sept. 18.
Courts invoke this doctrine to avoid deciding questions that are primarily political in nature and, therefore, best resolved by a legislative body.
