Amedisys Inc. won dismissal of a False Claims Act suit alleging that the company fraudulently billed federal health-care programs for home health services.
Whistleblowers Michael Pilat and Philip Maniscalco—who worked at the company’s Amherst, N.Y., center—alleged that Amedisys billed the government for medically unnecessary treatment, falsified time records, and inflated reimbursements by upcoding patients.
But their third amended complaint failed to allege fraud with sufficient particularity, and must be dismissed without leave to amend, Judge John L. Sinatra Jr., of the US District Court for the Western District of New York said in a Monday order.
