Allergan Gets False Claims Appeal Green Light

Drugmaker Allergan can immediately elevate a False Claims Act dispute to a federal appeals court before the trial court issues a final ruling in the case (United States ex rel. Wood v. Allergan, Inc., 2017 BL 150248, S.D.N.Y., 10-CV-5645, 5/4/17).

The U.S. District Court for the Southern District of New York said a dispute over whether whistle-blower John A. Wood could proceed with his lawsuit despite not being the first to make these particular allegations of fraud against Allergan in an FCA lawsuit should be allowed to be appealed immediately. The FCA generally prohibits copycat court filings.
