Abbott Defeats Former Employee’s False Claims Retaliation Suit

Abbott Laboratories Inc. escaped a former employee’s False Claims Act suit alleging it fired her because she complained about the company’s promotion of stent products, Absorb and Xience, in a ruling by the District of Massachusetts.

Plaintiff Ebonia Elliott-Lewis didn’t show that she engaged in protected conduct under the FCA because she complained primarily about her relationship with managers, company policy violations, and regulatory violations that have an unlikely connection to the submission of fraudulent claims to the government, Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts said.
