Teva False Claims Kickback Suit Dismissed at DOJ’s Request

The U.S. Justice Department convinced a federal court in Pennsylvania to dismiss a False Claims Act suit accusing Teva Pharmaceutical Products Ltd. of engaging in a kickback scheme to increase drug prescriptions.

The DOJ demonstrated that proceeding with whistleblower NHCA-TEV LLC’s lawsuit would impose a significant litigation cost burden on the government, said Judge Jan E. DuBois of the U.S. District Court for the Eastern District of Pennsylvania.

The government conducted a sufficient investigation into the claims before concluding it was unlikely the whistleblower would be successful, the court said.
