Regeneron Must Face Justice Department Lawsuit Citing Kickbacks

Federal prosecutors can proceed with claims that Regeneron Pharmaceuticals Inc. violated the False Claims Act by engaging in a kickback scheme to induce doctors to increase prescriptions of its macular degeneration drug, Eylea, a Massachusetts federal court said Friday.

The government sufficiently asserted that Regeneron funneled money into a charity, Chronic Disease Fund, now operating as Good Days, to reimburse copays of Eylea patients, Judge F. Dennis Saylor IV said in a decision denying a motion to dismiss.
