Pfizer False Claims Case Dropped at Request of Prosecutors (1)

The Justice Department properly requested dismissal of a false claims suit accusing EMD Serono Inc., Pfizer Inc., and others of engaging in a kickback scheme that defrauded Medicare and Medicaid, a federal court said.

The DOJ demonstrated that dismissal served the valid government purpose of avoiding litigation costs in a case that lacks sufficient factual and legal support, Judge Timothy J. Savage of the U.S. District Court for the Eastern District of Pennsylvania said.
